Boudreault has been applied in British Columbia. In Aitken v. British Columbia (Superintendent of Motor Vehicles) 2013 BCSC 363, Johnston J. upheld the ruling of the adjudicator that while the driver did not intend to drive, there was a realistic risk that he would change his mind and drive home.
