In Bortnikov v. Rakitova 2016 ONCA 427 (CanLII), the court found that neither party’s conduct met the very high threshold for bad faith under 24(8) of FLRs. The court found that the award of costs was reasonable, fair and proportionate in the circumstances of the case.
