In Blaine v. Hopkins, [1990] B.C.J. No. 2724, liability was established in a collision between the defendant and a moose. His passenger was injured. In finding the defendant liable, the trial judge relied on expert evidence that the defendant was exceeding the posted speed limit and, had he been travelling at or under the speed limit, the collision could have been avoided.
