The parties are encouraged to resolve the issue of costs between them. If they are unable to do so, I shall decide the issue of costs on the basis of written submissions. While not entirely successful, I view the defendants as the more successful party and thus presumptively entitled to reasonable, partial costs. The defendants shall have two weeks from the release of this judgment to serve and file their costs submissions of not more than three pages, double spaced, in addition to their bill of costs and any case law. The plaintiff shall have ten days to file responding submissions of the same length. There will be no reply without leave of the court. J.M. Woollcombe J.
