In Berry v. Berry, Justice Rosenberg framed this question by considering whether “there would be “irreparable harm to the best interests of the child”. In that case, which was not a child protection case, he considered “maximizing contact” with the father to be in the child’s best interests as well as “minimizing disruption.”
