In Bell v. Thorner, 2009 BCSC 44, the plaintiff, who was wearing dark clothing at night and in poor weather conditions, after disembarking from a bus, crossed an intersection in an unmarked crosswalk. He was well into the roadway when the defendant's vehicle struck him. The defendant, a new driver accompanied by several passengers, was travelling at the speed limit.
