Counsel for the plaintiff submits that Assu v. Chickite is authority for the proposition that this court has concurrent jurisdiction with the federal court to assess decisions of a band council, when the challenge to such a decision is made on the ground that the decision amounted to a breach of fiduciary duty owed by councillors to all band members. I think this point is well taken.
