This case bears some resemblance to the fact situation in Ark v. Thompson, where an initial collision, which was found to be entirely due to the negligence of the first defendant, left the plaintiff's vehicle resting broadside across the through lane. The second defendant motorist, who was travelling behind the plaintiff’s motor vehicle, then hit it as a result of failing to keep a proper lookout.
