As to the costs of appeal, the Respondent asks for an extraordinary costs award: Barrett v. Wood, 2007 ABCA 278 (CanLII), [2007] A.J. No. 946 where an appellant sought to argue for a third time an issue that was res judicata. The historical factual underpinnings of this case, in our opinion, warrant such an award. We direct that the Respondent shall have her costs of the appeal on a solicitor and client basis to be taxed in the usual fashion.
