With regard to sentence appeals, appellate courts generally defer to sentencing judges, but an appeal may be successful if the sentencing judge committed an error in principle, failed to consider a relevant factor, or erroneously considered an aggravating or mitigating factor and how it impacted the sentence, or if the sentence is demonstrably unfit. (R v. Agin, 2018 BCCA 133).
