The misplacement of paragraph 3 in part 3 rather than part 1 of the ANoCC is not a matter of substance because it can be fixed by a simple amendment. As in Bains v. Green, 2012 BCSC 1733 at para. 62, I direct that Jastram restructure the ANoCC and grant it leave to amend as necessary to rectify the misplacement. I approach this application on the basis of the pleading as it will be amended.
