Finally, the defendants rely on O'Connor v. Chapman, 2007 BCSC 657. In that case, the motor vehicle accident happened in British Columbia but liability was admitted and the only issue was damages. A judge of the court found that Alberta was the more appropriate forum because the plaintiff was a resident of Alberta, all the medical witnesses were in Alberta, and the plaintiff had been previously injured in an accident in Alberta.
