In what circumstances will an insurer be required to continue to pay disability benefits to an insured who has been spied on by the insurer?

British Columbia, Canada

The following excerpt is from Hedstrom v. Manufacturers Life Ins. Co., 2002 BCSC 1502 (CanLII):

In Poersch v. Aetna, referred to earlier, the insured had been receiving disability benefits from the defendant insurer for five years. After conducting extensive surveillance of the insured’s activities, the insurer suspended payment of the benefits. The insured sought a mandatory interlocutory injunction requiring the insurer to continue the payments.
