Where no agreement is in place assessment of the fee shall be on a quantum meruit basis. The Code of Professional Conduct provides in Rule X that a lawyer has an ethical duty to charge a fair and reasonable fee. The assessment of whether a fee is fair and reasonable requires inquiry into a number of factors (Stevenson v. Stanek, 1980 CanLII 2008 (SK QB), [1980] 4 W.W.R. 239).
