In what circumstances will a plaintiff who was hired to paint a house fall from a ladder?

British Columbia, Canada

The following excerpt is from Fochler v. Dancer-Poulin & Barnes, 2007 BCSC 294 (CanLII):

In Beronja v. Nagra, [2004] B.C.J. No. 575, 2004 BCSC 371, the plaintiff fell from a ladder while at the defendant’s home. The plaintiff and co-worker were hired to paint the home. After they had finished the job they went to the roof of the house to reattach telephone cable wire that had somehow become disconnected. The plaintiff was descending a ladder that he had used to access the roof when he lost his balance and fell to the ground. The ladder had been provided by the defendant but set up by the plaintiff.
