Factors to be considered in making a determination whether a contingency fee arrangement is fair and reasonable ought to include: whether the client fully understood and appreciated the nature of the agreement; the time expended by the lawyer; the legal complexity of the matter at issue; the results achieved; and, the risk assumed by the lawyer: Raphael Partners v. Lam, 2002 CarswellOnt 2880 (CA) at paras 37 and 50.
