Where there are two or more tortfeasors, the defendant is not excused from liability merely because other causal factors for which he or she is not responsible also helped produce the harm. It is sufficient if the defendant’s negligence was a part of the cause of the injury: Athey v. Leonati, 1996 CanLII 183 (SCC), [1996] 3 S.C.R. 458 at paras. 17-20.
