7 In Litt v. Gahia, February 15, 1995, MacKinnon J. in chambers allowed an application by a plaintiff to strike out a jury notice filed by I.C.B.C.. He commented upon Huddart J.'s decision in Cameron, stating: " She would not include the substantive common law right to determine the motor trial as a procedural right incidental to defending the action."
