In Perry v. Vargas, 2012 BCSC 1537, Mr. Justice Savage held that this discretion must be exercised sparingly and that the interests of justice as referred to in Rule 11-7(6)(c) are not a licence to ignore the requirements set out elsewhere in the rules.
